Terms of Service

1. Acceptance of Terms

By accessing or using PetPortraitGenerator (the “Service”) at pet-portrait-generator.com, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and PetPortraitGenerator.

2. Eligibility

You must be at least 13 years of age to use this Service (or 16 in certain EEA jurisdictions). By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Account Registration

You must create an account to use the Service. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately at [email protected] if you suspect unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Upload images you do not own or do not have the right to use
  • Upload images containing humans (faces, bodies) without their explicit consent
  • Upload images that are illegal, obscene, harmful, defamatory, or infringe third-party rights
  • Attempt to circumvent the credit system or exploit the service through automated means
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service in any way that could damage, overload, or impair its infrastructure
  • Impersonate any person, organization, or brand
  • Use the Service in violation of any applicable law or regulation

Violation of these rules may result in immediate account suspension without refund.

5. Credits and Payments

The Service operates on a credit system. Credits are required to generate portraits.

  • New accounts receive 2 free credits upon registration.
  • Additional credits can be purchased as described on our Pricing page.
  • Credits are non-transferable, non-refundable (except as described in our Refund Policy), and apply only to your account.
  • Credits do not expire.
  • Failed portrait generations result in automatic credit refunds to your account.
  • All prices are in US Dollars (USD) unless otherwise stated.
  • We reserve the right to change credit pricing with reasonable notice.

6. Intellectual Property

Your Content

You retain ownership of any original pet photos you upload. By uploading a photo, you grant us a limited, non-exclusive license to process the image for the purpose of generating your portrait. This license does not permit us to share, sell, or use your photos for any other purpose.

Generated Portraits

Subject to these Terms, we grant you a license to use generated portraits as follows:

  • Free & Standard credits: Personal, non-commercial use only (printing, sharing with friends and family, personal social media).
  • Premium credits: Broader commercial license included. You may use portraits in products you sell, marketing materials, and commercial print.

Our Service

The Service, including its design, software, and content (excluding user-uploaded content), is owned by PetPortraitGenerator and protected by copyright, trademark, and other intellectual property laws.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice. In the event of a planned service shutdown, we will provide at least 30 days' notice and offer refunds for unused purchased credits.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will meet your specific requirements or that generated portraits will meet your expectations of quality or accuracy.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PETPORTRAITGENERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 30 DAYS PRIOR TO THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless PetPortraitGenerator and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your uploaded content, or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in California, except that either party may seek injunctive relief in a court of competent jurisdiction.

EU/EEA consumers retain their rights under mandatory consumer protection laws of their country of residence, which may provide additional protections.

12. Termination

You may terminate your account at any time from the Settings page. We may terminate or suspend your account without prior notice for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature survive termination (including Intellectual Property, Limitation of Liability, and Indemnification) shall remain in effect.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email and by updating the “Last updated” date. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
